A federal judge has cleared the way for Tennessee navigators.

U.S. District Judge Todd Campbell, a judge in Nashville, Tenn., issued a temporary order that blocks state efforts to enforce emergency navigator certification rules.

Julie McPeak, the state’s insurance commissioner, and Democratic Gov. Bill Haslam, have argued the state needs to be able to set standards for navigators and other exchange helpers to protect consumers from fraud and incompetence.

The Service Employees International Union, Local 205, and other plaintiffs argued in their complaint that the emergency rules infringe on the free-speech rights of the would-be exchange helpers, interfere with the application of a federal law in an unconstitutional way, and interfere with the ability of people with disabilities to get help with using the exchanges.
